Individuals who qualify under the GRP Rules are taxable at the rate of 15% on foreign source income remitted to Malta with the possibility to claim double taxation relief. A physical residence permit in Malta can also be linked to a GRP application.

Recognising the need of owners of these businesses to have trusted qualified personnel to occupy certain positions within their operations, Malta has introduced the Highly Qualified Persons Rules.

Under these Rules tax on income received by a beneficiary under a ‘qualifying contract’ of employment in respect of activities carried out in Malta, shall be charged at a flat rate of 15%.

The attractiveness of business setups in Malta has prompted an increased requirement of skilled personnel across all industries. Identity Malta, which is the entity responsible for work permits in Malta, introduced a programme entitled ‘The Key Employee Initiative’ (KEI). The aim of the KEI is to facilitate and fast track the application process to highly-specialised third-country nationals who seek employment in Malta.

Third-country nationals wishing to work in Malta are required to submit an application for an employment licence to the Employment and Training Corporation (ETC). They are also required to apply for a residence permit (residence card) at the Department for Citizenship and Expatriate Affairs for the said authorization. While the Malta work visa application shall be submitted by the third-country national, it has to be endorsed by the employer/prospective employer.

The Government of Malta has launched a Programme providing a special tax status for EU/EEA, Swiss and Third Country nationals, with the exclusion of Maltese nationals, who are in receipt of a Widow’s/Widower’s Benefit or Pension from the United Nations Joint Staff Pension Fund, under certain established conditions.

Individuals, who qualify for the said special tax status under the stipulated terms and conditions shall benefit from an exemption on pension or a Widow’s/Widower’s Benefit of which at least 40% must be received in Malta. Successful applicants shall also benefit from a reduced tax rate of 15% on income arising outside Malta and which is remitted to Malta with the added possibility to claim double taxation relief. Meanwhile, any Income or Capital Gains arising in Malta are taxable at a flat rate of 35% with the exception of transfers of Immovable Property situated in Malta and for which a Final Withholding Tax is applicable.
