Frequently Asked Questions - Malta Residence and Visa Programme (MRVP)

The GRP is a tax status programme aimed at the global traveller who might not have a fixed place of tax residence. These rules confer a special tax status to Non-EU/EEA/Swiss nationals. Individuals who qualify under the GRP Rules are taxable at the rate of 15% on foreign source income remitted to Malta subject to a minimum tax annual payment of €15,000, with the possibility to claim double taxation relief. Other income chargeable to tax in Malta in accordance with the applicable legislation is charged to tax at the rate of 35%. A physical residence permit in Malta can also be linked to a GRP application.

Over the years Malta has attracted a large number of multinational businesses in target industries of financial services, aviation services, gaming services and assisted reproductive technology.

Under these Rules tax on income received by a beneficiary under a ‘qualifying contract’ of employment in respect of activities carried out in Malta, shall be charged at a flat rate of 15%.  The 15% flat rate is imposed up to a maximum income of €5,000,000, with the excess being exempt from tax.

The attractiveness of business setups in Malta has prompted an increased requirement of skilled personnel across all industries. This has instigated the introduction of the Key Employee Initiative which provides the applicant with a residence and work permit simultaneously within circa 5 working days.

The aim of the KEI is to facilitate and fast track the single permit application process to highly-specialised third-country nationals and/or third-country nationals who are to occupy a managerial post,  seeking employment in Malta. To qualify, the annual gross salary offered to the applicant must be of at least €30,000.  Upon a successful application process, the applicant would be issued with a residence permit valid for 1 year. Subsequently, this may be renewed for a longer period not exceeding three years, subject to fulfilment of the applicable conditions.

The United Nations Pension Program Rules confers a special tax status to those individuals who qualify in terms of the Programme. Eligible individuals shall benefit from an exemption on the United Nations Pension or a Widow’s/Widower’s Benefit of which at least 40% must be received in Malta. Successful applicants shall also benefit from a reduced tax rate of 15% on income arising outside Malta and which is remitted to Malta, subject to a minimum annual tax payment of €10,000 with an additional €5,000 in the event that both spouses are in receipt of a United Nations pension, with the added possibility to claim double taxation relief.

The Malta Retirement Programme Rules confers a special tax status to EU/EEA/Swiss nationals who are not in an employment relationship and are in receipt of a pension as their regular source of income. Said pension must constitute at least 75% of the individual’s chargeable income.

A beneficiary under the Malta Retirement Programme Rules shall be subject to tax on income arising outside of Malta which is received in and remitted to Malta at a flat rate of fifteen 15% provided that the minimum amount of tax payable in terms of these rules in respect of any year of assessment shall be seven thousand five hundred Euro (€7,500) in respect of the beneficiary and five hundred Euro (€500) per year of assessment for every dependant and every special carer.

Income not chargeable to tax under these rules at the rate established in the preceding paragraph shall be charged as separate income at the rate of thirty-five percent (35%).
